TERMS AND CONDITIONS
1. Introduction
Welcome to Natraj IT Solutions. These Terms and Conditions outline the rules and regulations for the use of our services. By accessing our website and engaging our services, you agree to these Terms and Conditions in full, in compliance with the Australian Consumer Law (ACL) and relevant NSW regulations.
2. Free Quotation
- We provide a System Requirement Specification (SRS) document based on the client’s requirements, including system design in JPG format, at no cost.
3. Design and Development Costs
- A 25% upfront payment of the design and development cost estimated in the SRS is required.
- Domain registration and server hosting costs will be charged separately.
- All charges will be clearly disclosed before engagement to comply with NSW consumer law.
4. Maintenance and Support
- Regular Maintenance and Support: Charged based on the agreed Service Level Agreement (SLA).
- Emergency Maintenance and Support: Additional charges may apply for emergency requests outside routine checks, depending on their nature and frequency.
5. Scalability
- Scalability Requests: Additional charges will apply for scalability requirements requested by the client. All costs will be transparently communicated prior to implementation.
6. Additional Requirements
- Change in Requirements Exceeding Three Times: If changes exceed three iterations, additional charges will apply, determined based on the scope of changes. Clients will be notified of any associated costs upfront as per NSW consumer protection laws.
7. Payment Terms
- Payments must be made as per the agreed terms stated in the invoice.
- If payments are delayed or not made, Natraj IT Solutions reserves the right to withdraw services.
- In cases where partial payments are made but the client decides to terminate services, no refunds will be issued; however, all completed work up to that point will remain with the client.
- Payment terms comply with NSW laws requiring transparency and fairness in contracts.
8. Termination
- Either party may terminate the service agreement with written notice.
- Upon termination, all outstanding payments must be settled within 30 days.
- Clients are entitled to a clear explanation of termination terms under NSW consumer law.
9. Limitation of Liability
- Natraj IT Solutions is not liable for any indirect, incidental, or consequential damages arising from the use of our services unless otherwise required by law.
- Liability limitations do not exclude mandatory consumer guarantees under ACL.
10. Governing Law
These Terms and Conditions are governed by and construed in accordance with the laws of New South Wales, Australia.
